Lawsuit: Pinnacle Metal Hip Implant Caused Metal Toxicity

pinnacle hip implant painA husband and wife from Rhode Island are suing DePuy Orthopaedics and parent company Johnson & Johnson for personal injury claims related to the Pinnacle Acetabular Cup System metal hip implant that was surgically placed in the husband.

Plaintiffs Scott and Susan M. allege that Scott experienced pain, discomfort, difficulty walking and metallosis as a result of the allegedly defective metal hip implant.

Scott claims in the metal hip replacement lawsuit that he would not have chosen to have the Pinnacle hip system implanted if he had prior knowledge that it could lead to the complications he has experienced.

Scott underwent two hip surgeries where the Pinnacle hip was implanted, one on his right hip in Nov. 2004 and the other on his left hip in March 2006.

As a result of the alleged defective Pinnacle hip system, Scott was forced to undergo additional hip revision surgery to remove both metal-on-metal hip implants in 2013 and 2014.

Scott and Susan have brought forth nineteen counts against the manufacturers including two counts of negligence, strict products liability allegations of defective design, manufacturing defect and failure to warn, gross negligence, fraudulent misrepresentation, and loss of consortium (spousal companionship).

Scott and Susan are seeking compensatory damages, punitive or exemplary damages, statutory damages, restitution damages, attorneys’ fees and costs and other relief as deemed appropriate by the court.

The Pinnacle Metal Hip Implant Lawsuit is Case No. 3:15-cv-04050-K in the U.S. District Court for the Northern District of Texas, Dallas Division.

Metal Hip Implants

DePuy’s Pinnacle is one of several hip implant models that is considered a metal-on-metal hip implant. While other hip implants are also made of metal, the moving metal components do not touch as they are separated by a plastic liner, removing complications from metal-on-metal friction.

Other metal-on metal hip implants include those made by Stryker, Wright, Biomet and other manufacturers.

The Pinnacle, in contrast to other hip implants, has metal components that touch, and these appear to be the catalyst for sparking hip surgery complications.

Hip Surgery Complications

Several hip surgery complications have been reported as a result of implantation with a metal hip implant. These complications arise from the friction created by the metal-on-metal design. When a patient moves, the metal components rub together, causing metal particles to flake off. These can then enter the bloodstream and surrounding tissues.

Reported complications include:

  • Tissue death surrounding the implant
  • Loosening of the implant due to tissue death
  • Endocrine disruption
  • Metallosis or metal poisoning
  • Heart or other organ failure
  • Cancer
  • Early hip implant failure requiring replacement

Metal Toxicity from Hip Replacement

Most of the complications of metal hip surgery are related to the metal used in hip replacements where the metal elements touch. Two types of metal used in hip replacements are responsible for the related complications: chromium and cobalt.

Metallosis and metal poisoning are the main reasons why the remaining complications occur. The metals cause tissue to die and the subsequent loosening of the implant, leading to device failure and they can also directly cause tumors and cancer to form.

Metal toxicity from hip replacement also causes the hormones to be disrupted, leading to heart and organ failure.
