A Lipitor lawsuit was filed by a Florida woman as part of the larger Lipitor multidistrict litigation alleging the cholesterol drug caused users to develop type-2 diabetes.
Plaintiff Joan C. filed her Lipitor type-2 diabetes lawsuit in Florida federal court before it was transferred to South Carolina federal court with the other consolidated Lipitor MDL cases.
According to the Lipitor lawsuit, Joan was prescribed Lipitor in September 2005. She continued to take Lipitor until July 2012, six years after she was diagnosed with type-2 diabetes, which she alleges was caused by her use of Pfizer’s drug.
Now at the age of 53, Joan suffers from “grievous bodily injury and consequently economic and other losses, including but not limited to pain and suffering, emotional distress and loss of enjoyment of life,” because of her development of Lipitor type-2 diabetes.
Joan accuses Pfizer of negligence, negligent misrepresentation, negligent design, design defect, failure to warn, breach of express warranty, breach of implied warranties, constructive fraud, unjust enrichment, and punitive damages.
The Lipitor Lawsuit is Case No. 2:15-cv-02775-RMG, in the U.S. District Court for the District of South Carolina.
It is part of the Lipitor Type-2 Diabetes MDL known as In re: Lipitor (Atorvastin Calcium) Marketing, Sales Practices, and Products Liability Litigation, MDL No. 2:14-mn-02502-RMG, in the same U.S. District Court.
Type-2 Diabetes and Lipitor Users
According to reports, over 4,000 women who have used Pfizer’s popular cholesterol medication have reported developing Lipitor type-2 diabetes. Many of these women have filed Lipitor lawsuits against Pfizer seeking compensation for Lipitor side effects, injuries, and complications. The majority of these Lipitor lawsuits have been consolidated in the Lipitor MDL.
In August 2011, the FDA issued a notice requiring Pfizer to include new type-2 diabetes risk warning on its marketing and labeling for Lipitor side effects. A year later, the agency also published a general mandate to all statin drug manufacturers to include a type-2 diabetes warning. Pfizer finally complied with the FDA mandate in February 2012.
While the Lipitor labeling change benefits current and future Lipitor consumers, it does not reverse or repair the Lipitor side effects many females developed before the 2012 update. As a result, many of these consumers have filed Lipitor lawsuits, seeking compensation for developing type-2 diabetes.
