AbbVie, maker of the popular low-t drug AndroGel, will be the first manufacturer of testosterone products to face bellwether trials, as the nearly 2,000 lawsuits consolidated into a multidistrict litigation in Illinois move forward through the court system.
Six representative cases have been selected for the bellwether trials expected to begin in October 2016. Abbvie counsel, along with plaintiffs suing the low testosterone drug manufacturer, have been asked to select 32 cases by Oct. 31 of this year.
Abbvie has found this problematic and has requested that the court take a more active role in the selection of the testosterone side effects lawsuits. In a recent filing, AbbVie claimed that allowing attorneys to make the selections “frustrates rather than facilitates” the pretrial process.
The two most commonly reported injuries allegedly caused by taking the low testosterone treatment AndroGel are heart attacks and blood clots. Lawyers on both sides have been asked to come up with 16 lawsuits for each of the testosterone product side effects for the bellwether trials beginning next year.
The first set heard will be from those plaintiffs that claim the low-t medication caused in blood clots.
AbbVie has requested the dismissal of nearly 170 low-T drug lawsuits claiming that the cases did not have pertinent information including which pharmacies filled the prescriptions and the names of the doctors who prescribed AndroGel to their patients. However, the plaintiff’s counsel has argued this is a calculated move on behalf of AbbVie for the bellwether process, when the manufacturer could easily obtain the information by getting authorization to view plaintiff medical records.
Testosterone Replacement Therapy Overview
Over the last 10 years, the number of men in the U.S. who have used a testosterone therapy product has tripled. More then five million men take a form of low-t treatment including testosterone creams, testosterone injections, testosterone patches or testosterone gels.
These testosterone products are marketed to men as a way to increase sex drive and gain muscle mass. However, according to recent studies the low-t medications can cause life-threatening side effects including deep vein thrombosis, pulmonary embolism, stroke, heart attack or even sudden death.
The U.S. Food and Drug Administration required testosterone product manufacturers to revise drug warning labels to include a caution about the increased risk of developing blood clots in June 2014. The FDA stated that they were also investigating the possible link of low-t drugs to heart attacks and strokes. The federal agency has asked testosterone drug manufacturers to plan clinical trials to help determine the health risks.
Testosterone Product Lawsuits
The number of low-t drug lawsuits continues to grow as consumers claim they were not fully warned about the serious side effects linked to the low testosterone products.
Some plaintiffs claim that manufacturers invented “low-t” as a medical condition in order to boost sales of their products when, in reality, having low testosterone is part of the natural aging process.
The nearly 2,000 testosterone product lawsuits has affected the industry. AbbVie has reported that sales of AndroGel had dropped more than 30 percent as of the first half of this year.
Other low-t drug manufacturers face numerous lawsuits as well, but AndroGel is the most commonly used testosterone product, dominating the market with about a 65 percent market share.
Bellwether trials for the other low testosterone manufacturers are expected to begin in the second half of 2017.
