Couple Claims that Effexor Birth Defects Caused Baby’s Death

A couple claims that their daughter was born with fatal birth defects that were allegedly caused by the antidepressant Effexor.

Plaintiffs Christine and Matthew M. are filed the birth defects lawsuit over the death of their daughter, who they say was born with certain congenital birth defects related to the antidepressant Effexor.

The couple claims that in 2008, after Christine took Effexor during pregnancy, their daughter was born with birth defects including valvular anomalies, PFD with left to right shunting, and atrial myopathy. The daughter died in September 2008.

Christine and Matthew now allege that the child’s birth defects and subsequent death were related to the Effexor Christine took while pregnant.

Christine says in the Effexor lawsuit that had she known about the alleged link between Effexor and birth defects, she would not have taken it during pregnancy.

The couple alleges that Pfizer either knew or should have known that Effexor “posed an increased risk of congenital birth defects” in children whose mothers took the drug during pregnancy.

They allude to evidence that shows antidepressants in the same class as Effexor had been linked to lower gestational age and birth weight, longer hospital stays, and lower scores on other sets of used to evaluate the well-being on newborns.

The named defendants in this Effexor lawsuit are Pfizer Inc. and its related companies J.B. Roerig and Co. and Wyeth Pharmaceuticals Inc., all of whom the plaintiffs allege were involved in the development, manufacture or distribution of Effexor.

Christine and Matthew’s birth defect lawsuit asserts claims based on theories of defective product design, failure to warn, negligence, misrepresentation, fraud, concealment, and breach of warranty.

For harm their daughter suffered prior to her death, they are bringing claims as a survival action on behalf of the daughter’s estate.

They are also bringing a claim on their own behalf for wrongful death, which would compensate them for their own harm suffered due to the loss of their daughter.

Effexor and Birth Defects

Effexor is Pfizer’s brand name for the drug venlafaxine, one of a class of antidepressant drugs known as serotonin norepinephrine reuptake inhibitors, or SNRIs.

Effexor has been on the market since initial FDA approval in 1993. It’s now approved as a treatment for major depressive disorder and generalized anxiety disorder.

The current FDA-approved label for Effexor mention that while no adequate and well-controlled studies have been conducted in pregnant women, studies in animals found some instances of decreased weight, stillbirths, and deaths shortly after birth. The label states that Effexor should be taken during pregnancy only if clearly needed.

The Effexor MDL

Christine and Matthew filed this Effexor lawsuit in February 2015 as part of the multidistrict litigation going on in a Pennsylvania federal court. The Effexor MDL was established by an August 2013 order of the federal Judicial Panel on Multidistrict Litigation consolidating nine Effexor lawsuits for coordinated pretrial proceedings.

By January 2015, the number of individual claims in the MDL had grown to 65. However, beginning Jan. 22 plaintiffs behind 26 of those claims had begun to seek voluntary dismissal of their own claims.

This Effexor Birth Defect Lawsuit is Case No. 2:15-CV-00570, in the U.S. District Court for the Eastern District of Pennsylvania.
