A recent asbestos lung cancer lawsuit, alleges that asbestos exposure led to the wrongful death of a former railroad worker.
Plaintiffs Chuck H. and Karen C. filed the asbestos lung cancer lawsuit against Port Terminal Railroad Association (PTRA) and Union Pacific Railroad Company, for allegedly causing the death of Leon H.
Leon’s estate executors claim that the railroad companies had knowingly exposed Leon to deadly asbestos fibers, which eventually lead to his death.
According to the absestos lung cancer lawsuit, Leon had been employed by Missouri Pacific Railroad from 1969 to 1963, and PTRA from 1963 to 2002. During his employment, Leon had been allegedly exposed to asbestos on a daily basis due to his job and the materials that he worked with.
Both railroad companies had taken up asbestos for manufacturing purposes, due to its chemical and fire resistant qualities. Previously, asbestos had been used an economic and efficient building material by various companies across America, as well as the United States Navy.
Lean’s executors allege that at no point in time did the defendants inform Leon of the potential dangers associated with asbestos, nor did they provide any protective equipment.
Chuck and Karen both insist that if Leon had known about the asbestos exposure, he would have discontinued his employment with the companies. Furthermore, the defendants also could have put the decedent’s family at risk due to second-hand asbestos exposure, due to the fibers attaching to Leon’s clothes.
The plaintiff attorneys state that the defendants had the civil responsibility of warning their clients of the asbestos exposure, because the decedent had no reason to suspect that he was in an unreasonably danger environment.
Overview of Asbestos Lung Cancer Allegations
Unfortunately, asbestos has been linked to a number of severe health complications. According to medical experts, asbestos lung cancer and other asbestos-related diseases take years to develop and progress to the stage where the victims start showing physical symptoms.
In fact, experts warn that asbestos lung cancer can take between 20 years to 50 years to show any presence, often leading to latent diagnoses and little treatment options.
Leon’s case was no different, as he was diagnosed with asbestos lung cancer on Oct. 5, 2012. His condition was diagnosed at a latent stage of prognosis, leaving him with limited treatment options and ultimately resulted in his death on Jan. 25, 2013.
