In early August, another Lipitor lawsuit joined the growing multidistrict litigation against Pfizer Inc., alleging that the brand’s popular cholesterol medication is linked to an increase in diabetes and type-2 diabetes injuries.
Plaintiff Tobi H. is a resident of Louisiana who alleges she sustained Liptor side effects after taking the popular cholesterol-managing drug.
She is pursuing a Lipitor diabetes lawsuit against Pfizer for failing to warn her and the medical community as a whole about possible type-2 diabetes injuries related to the use of the statin drug.
61-year old Tobi was first prescribed Lipitor in 1999 and continued to take Lipitor until August of 2015. She discontinued her use of the drug presumably after she was diagnosed with type-2 diabetes in 2015, a condition she attributes to her use of Lipitor.
According to her Lipitor lawsuit, Tobi “has suffered severe and permanent physical and emotional injuries including, but not limited to, the development of Type 2 Diabetes as a result of her ingestion of the prescription drug Lipitor (atorvastatin calcium).”
Tobi alleges that because of Pfizer’s actions or inactions, she suffered serious bodily injury, economic and non-economic losses, pain and suffering, emotional distress, and loss of enjoyment of life.
Tobi brings several allegations against the drug manufacturer, including claims of negligence, negligent misrepresentation, negligent design, design defect, failure to warn, breach of express warranty, breach of implied warranties, fraud and misrepresentation, constructive fraud, unjust enrichment, and punitive damages.
Lipitor is a statin drug used to lower an individuals blood cholesterol and to prevent serious cardiovascular disease. Since 1996, it has been approved as a cholesterol-managing medication and has been one of Pfizer’s blockbuster drugs.
However, recent medical studies have demonstrated a link between Lipitor use and the eventual development of type-2 diabetes. For example, the Archives of Internal Medicine published a Lipitor study that found female patients who took statin drugs like Lipitor between the ages of 50 and 79 were 48 percent more likely to develop type-2 diabetes when compared to their non-pharmaceutical drug taking counterparts.
Because of the numerous Lipitor studies and Lipitor diabetes lawsuits, the FDA mandated that Pfizer update Lipitor’s warning label in February 2012 to warn consumers about the increased risk type-2 diabetes associated with the drug.
The Lipitor Lawsuit is Case No. 2:15-cv-03059-RMG and is part of the Lipitor MDL known as In Re: Lipitor (Atorvastatin Calcium) Marketing, Sales Practices and Products Liability Litigation, MDL No. 2:14-mn-02502-RMG, in the U.S. District Court for the District of South Carolina, Charleston Division.
