Xarelto Lawsuit Adds to Growing Multidistrict Litigation

XareltoA Florida resident alleges that Bayer Healthcare and Janssen Pharmaceuticals failed to warn patients and provide information to the medical community about the increased risks of gastrointestinal bleeding events associated with taking the blood thinning drug Xarelto.

According to the Xarelto lawsuit, plaintiff Helena M. used Xarelto beginning in April 2013 and she subsequently experienced gastrointestinal bleeding, for which she was hospitalized in December 2013.

The plaintiff also alleges other life-threatening severe and personal injuries that were a result of Bayer and Janssen’s failure to warn about Xarelto bleeding side effects.

Helena has filed her Xarelto lawsuit in the multidistrict litigation currently pending in the U.S. District Court for the Eastern District of Louisiana.

Xarelto Side Effects, Internal Bleeding

Xarelto (rivaroxaban) is one of the latest generation of anticoagulant drugs designed to treat patients at risk of deep vein thrombosis (the formation of blood clots deep under the skin surface).

Along with two similar medications (Pradaxa and Eliquis), Xarelto was intended to replace Warfarin, a blood thinner medication that has been the standard treatment for this condition since the early 1950s.

The advertised advantage of Xarelto and similar medications is that patients do not have to endure frequent monitoring and have less dietary restrictions; these prescriptions have far fewer drug and food interactions than Warfarin.

The most serious side effect associated with Xarelto is uncontrollable internal bleeding. Unlike other blood thinning drugs, there is no antidote for Xarelto.

This means that if a patient begins to bleed from Xarelto there is no way to reverse this until Xarelto is completely out of the body. This has resulted in a number of reported hospitalizations and deaths from Xarelto bleeding.

Xarelto Multidistrict Litigation

A multidistrict litigation was formed for the federally filed Xarelto lawsuits in December 2014. A motion was made to make this consolidation due to the large and growing number of cases filed in the federal court system against the manufacturers of Xarelto.

These lawsuits were able to be consolidated because they made similar allegations against the same defendants, the allegations being that Xarelto causes severe uncontrollable internal bleeding that can lead to serious injury and death in patients and that the manufacturers were aware of the dangers yet put the drug to market anyway. There are currently more than 1,200 cases in the MDL.

The Xarelto MDL has become one of the fastest growing mass torts concerning a product liability claim because the number of cases filed has significantly increased since the MDL was formed.

The purpose of an MDL is to expedite the litigation process for all parties involved, save on judicial resources, and speed up the pretrial litigation and discovery process.

Judge Eldon Fallon, the District Court judge who is presiding over the Xarelto multidistrict litigation, issued the order that scheduled the first four Xarelto bellwether trials.

The first trial will be held in the Eastern District of Louisiana on Feb. 6, 2017. The second trial will be held in the same district on Mar. 13, 2017.

For the third trial the venue will be moved to Mississippi and be held on Apr. 24, 2017. For the fourth trial, the venue will be moved to Texas and the trial will be held on May 30, 2017.
