Who’s Affected
Have you experienced difficulty recovering insurance property claim money from your mortgage company?
If you have a mortgage and your home suffered damage, you probably made a claim through your homeowners insurance. Some homeowners have encountered trouble accessing this money, required for repairs. Typically, an insurance company issues an insurance claim settlement check payable to both the homeowner and the mortgage company. The check is sent to the homeowner, who endorses it and then sends it to the mortgage company to endorse and cash.
However, homeowners have discovered how difficult it can be for mortgage company to release their money, with many reporting spending hours on the phone with their mortgage companies, only to have them refuse to release the funds. This can leave the repairs in limbo, with contractors waiting on their portion of the funds before they complete necessary work.
If you have filed an insurance claim for property damage, you may be entitled to money from your mortgage company. Submit your information now for a free case evaluation. If you qualify, a lawyer will contact you to discuss the details of your case.
Insurance Claim Settlements
Your homeowners insurance policy protects your home from damage caused by wind, water, fire, theft, and other events. When you borrowed money to purchase your home, you agreed that the mortgage company would be coinsured, which prevents a homeowner from cashing an insurance check without repairing the property.
Consequently, insurance companies will issue checks payable to the homeowner and the mortgage company. The homeowner must endorse the check and send it to the mortgage company to endorse. Often, the mortgage company will deposit the check into its own account and release the funds to the homeowner as the rebuilding process begins.
Some homeowners have reported mortgage companies refuse to release the checks to enable repairs to begin. Other homeowners have trouble collecting their funds, even after the work has been completed, even after spending hours on the telephone with multiple people from the mortgage company.
Homeowners may be deterred by this burdensome process and give up trying to access their own money, subjecting themselves to thousands of dollars in losses. To make matters even worse, mortgage companies, in their account statements and bills for payment, fail to disclose that they are keeping these insurance payments.
Get the Money You Deserve
An investigation has been launched into allegations that some banks and mortgage companies are in violation of the mortgage agreement, refusing to release homeowners’ insurance money, putting up hurdles to deter homeowners from accessing the money, and failing to disclose to homeowners their retention of this money. If this happened to you, you may be able to take legal action against your mortgage company.
