A settlement has been reached in a class action lawsuit alleging Circle K Stores Inc. violated California law with regard to some of its policies for non-exempt store employees.

If you worked for Circle K as a non-exempt store employee in California at any point from May 1, 2008 through Oct. 9, 2015, you may be eligible for benefits from the class action settlement.

The Circle K class action lawsuit was initially filed by plaintiff Chelly Bergstrom in 2012. Circle K operates convenience stores in the state of California and throughout the United States.

The wage and hour class action settlement will resolve allegations that Circle K violates California labor laws and unfair competition laws by failing to provide meal and rest breaks, failing to pay all vacation wages, failing to keep adequate records, and failing to timely pay all wages owed at the end of employment.

Circle K denies that it violated the law, but it has agreed to settle the class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

The Circle K class action settlement was preliminarily approved on Oct. 16, 2015. If you wish to exclude yourself from the Circle K settlement, you must do so no later than Jan. 9, 2016.

Who’s Eligible

Class Members of the Circle K settlement include anyone who worked for Circle K as a non-exempt store employee in California at any point during the period from May 1, 2008 to Oct. 9, 2015.

To qualify for benefits from the wage and hour class action settlement, you must not have previously agreed to a general release of claims against Circle K.

Potential Award

Varies. The amount each Class Member is eligible to receive will be calculated based on the total number of workweeks they were employed as a non-exempt Circle K store employee in California. The settlement fund will be distributed on a pro rata basis.
