GlaxoSmithKline (GSK) has been hit with a lawsuit from an Alabama couple who claims Zofran side effects caused their twin babies’ congenital birth defects.
Plaintiffs Darcy and Robert G. filed the Zofran birth defects lawsuit on behalf of their twins, who were born in 2013.
Darcy took generic Zofran to treat morning sickness during her first trimester of pregnancy. The twins were both born with severe heart defects, namely a “hole in the heart” (atrial septal defect). According to the Zofran lawsuit, there is no family history of heart defects and no indication of a genetic reason for their condition.
The Zofran birth defects lawsuit further specifies that the twins have required specialty cardiology, medical care and monitoring since their birth.
The Zofran lawsuit states “GSK not only concealed this knowledge from healthcare providers and consumers in the United States, and failed to warn of the risk of birth defects, but GSK also illegally and fraudulently promoted Zofran to physicians and patients specifically for the treatment of morning sickness in pregnant women.”
Darcy and Robert’s attorneys claim GSK knew that Zofran could cross the placenta based on animal studies from the 1980s.
About Zofran
Zofran (ondansetron) is an anti-nausea drug approved by the FDA for chemotherapy patients who experience nausea and vomiting as a result of their cancer treatments. However, the drug is also commonly prescribed off-label to women who suffer from morning sickness during pregnancy.
Recent medical studies and post-market reports have raised the suggestion of a possible link between Zofran and birth defects including:
- Atrial septal defect
- Ventricular septal defect
- Cleft palate and lip
- Fetal growth restriction in the womb
- Jaundice
- Kidney defects
- Heart murmur
- Fetal death
A study that included all women giving birth in Denmark between 1997 and 2010 (903,207 births) found the risk for major congenital heart defects doubled with use of Zofran to treat nausea and vomiting during the first trimester.
In 2006, a Hong Kong-based study showed Zofran readily crosses the human placenta during the first trimester of pregnancy, and was detected in every sample of fetal tissue collected from forty-one patients.
Zofran Birth Defects Lawsuits
As of August 2015, there were at least 33 Zofran lawsuits filed in 20 different federal district courts on behalf of families of children who were born with severe birth defects after allegedly being exposed to Zofran in utero.
