Checks have been mailed to Class Members who filed claims for a class action settlement over allegations Path Inc. violated the Telephone Consumer Protection Act (TCPA), according to some of our readers.
On Dec. 10, readers posted on the Top Class Actions Facebook page that they had received payments of $70 from the Path TCPA settlement.
The Path TCPA class action settlement resolves allegations that the social networking service violated the TCPA by using an automatic telephone dialing system, or artificial or prerecorded voice, to contact consumers on their cell phones without their consent.
The Path class action lawsuit was initially filed in 2013 by plaintiff Kevin Sterk, who alleged he had received unwanted text messages from Path Inc. The text messages allegedly included a link for Sterk to join the service, but did not include an option for him to opt out of receiving further messages.
Under the terms of the Path class action settlement, consumers who received certain type of text message on a cell phone from or on behalf of Path Inc. between March 28, 2009 and March 28, 2013 may have been eligible for a payment of up to $70.
Specifically, Class Members of the Path TCPA settlement included all persons who received a text message without their consent from Path short code 59730 that contained a website URL that contained a website URL that allowed the recipient to download the Path mobile application.
Path Inc. denies that it violated the TCPA, but it agreed to settle the class action lawsuit to avoid the expense and uncertainty of ongoing litigation. The Path TCPA settlement was granted final approval on Sept. 21, 2015.
The deadline to file a claim for the Path text message class action settlement passed on Oct. 5, 2015.
