A $6 million class action settlement was reached with Richmond, the American International University in London, Inc. and the American Institute For Foreign Study, Inc. (AIFS) to resolve allegations that they had sent unsolicited fax advertisements to several recipients. If you received an unsolicited fax from one of the two named defendants, you may qualify to benefit from this class action settlement.
Plaintiff Bais Yaakov of Spring Valley filed the class action lawsuit against Richmond and AIFS alleging that the two entities sent thousands of fax advertisements to Bais Yaakov and others around the country, which is a violation of the Telephone Consumer Protection Act (TCPA).
The TCPA is a federal law that has existed since 1991. It was passed to limit businesses from harassing Americans with unsolicited telemarketing calls, unsolicited text messages and unsolicited advertisements sent to fax machines — this includes fax machines owned by businesses and individuals.
According to the FCC, when companies send an unsolicited fax, they must include information on how recipients may opt out of receiving unwanted fax advertisements in the future.
Class Members include any person or entity that received a fax advertisement from Richmond between July 1, 2009 and July 1, 2013 or AIFS from Aug. 22, 2010 through Aug. 22, 2014.
Richmond and AIFS do not admit to any wrong doing, but they have agreed to the terms of this TCPA class action settlement to avoid the cost and risk of going to trial. This junk fax class action settlement was granted preliminary approval on Nov. 4 by U.S. District Judge Cathy Seibel.
Who’s Eligible
This TCPA class action settlement is for:
- All persons and entities to who Richmond sent fax advertisements from July 1, 2009 through July 1, 2013.
- All persons and entities to whom AIFS sent fax advertisements from Aug. 22, 2010 through Aug. 22, 2014.
Potential Award
Class Members may receive $500 per fax advertisement they received from Richmond and/or AIFS during the Class Period, if Class Members submit a valid claim form as well as copies of the fax advertisements.
If a Class Member does not have copies of the fax advertisements, they may still file a valid claim form along with a sworn affidavit stating how many fax advertisements were received. In that case, Class Members may receive $175 for one fax advertisement, $200 for two, $225 for three, $250 for four and $275 for five or more.
Proof of Purchase
Class Members will need to submit a valid claim form and copies of the fax advertisements or a valid claim form and a sworn affidavit or declaration stating how many faxes were received.
