Three real estate renovators connected with a San Antonio, Texas worksite have been cited for a total of $112,000 in penalties for asbestos exposure.
According to federal safety regulators, FBZ Broadway LP, One Eighty Construction Inc., and Roscoe Properties Inc. allegedly exposed workers to asbestos at a construction worksite. These three companies are all owned by Jason Berkowitz and based out of Austin, Texas.
The construction site, located at a residential apartment, was inspected on May 29, 2015. After the inspection, FBZ Broadway LP and Roscoe Properties Inc. were each cited. Each company was cited over one willful violation: failing to determine the location and quantity of asbestos.
On April 28, FBZ Broadway had been cited for the same violation. One Eighty Construction was also cited for one willful violation: failing to ensure that workers followed asbestos removal practices.
Each company was fined varying amounts. FBZ Broadway LP was fined $14,000; One Eighty Construction Inc. was fined $35,000; and Roscoe Properties Inc. was fined $63,000.
Combined, the three companies employ approximately 261 workers. After receiving these citations, the companies have 15 business days to respond. They must either comply with the fines, request a conference with the OSHA (Occupational Safety and Health Administration) area director, or contest the citations and penalties.
Asbestos Mesothelioma
Mesothelioma is a cancer that attacks the lining of the lungs, and has been primarily associated with exposure to asbestos. Asbestos lung cancer takes decades to develop, but quickly spreads to distant organs. Because of these factors, asbestos lung cancer is commonly diagnosed at a late stage of development.
Asbestos is a naturally occurring mineral used for commercial purposes such as electrical or building insulation, as well as countless other uses. Asbestos’ microscopic fibers can accumulate in the lungs and cause several critical health problems, the worst of which is lung cancer.
Asbestos Mesothelioma Lawsuits
Plaintiffs involved in asbestos mesothelioma lawsuits allege that their lung cancer diagnoses were a direct result of asbestos exposure. This exposure and subsequent mesothelioma diagnosis is due to the actions and inactions of manufacturers and contractors involved in the construction and equipment.
Asbestos mesothelioma lawsuit plaintiffs claim that these manufacturers and contractors failed to adequately warn about the sometimes lethal hazards of asbestos dust exposure. In some cases, they neglected to offer any warning at all.
Asbestos dust and fibers frequently become airborne, and could enter into a construction worker’s lungs. As a result of exposure during years of work, plaintiffs may be diagnosed with malignant mesothelioma.
Asbestos mesothelioma can lead to physical, mental, and emotional pain and suffering, as well as serious medical expenses. The disease can eventually become fatal.
Asbestos lawsuits often allege that the company was aware (or should have been aware) of the dangerous nature of their asbestos-containing materials. In some cases, lawsuits claim that not only was the defendant aware of the presence of asbestos, but also its ability to cause disease and even fatalities.
These lawsuits allege that, for these reasons, asbestos exposure and subsequent diagnosis is foreseeable and should have been anticipated and avoided by the defendants.
Many people exposed to asbestos, often construction workers, have filed asbestos lawsuits after being diagnosed with mesothelioma.
If you or someone you know has been diagnosed with or died from an asbestos-related disease, and have been exposed to asbestos, you may be able to file an asbestos mesothelioma lawsuit.
