On Dec. 10, an appeal to a class action settlement over allegations certain Waggin’ Train and Canyon Creek Ranch dog treats caused pets to get sick was dismissed. As a result, the settlement status has been changed to “Pre-Disbursement,” meaning that checks may soon be mailed to Class Members who filed valid claims.
The dog treat settlement will resolve three class action lawsuits alleging Waggin’ Train and Canyon Creek Ranch dog treats that were imported from or contained ingredients from China were defective and caused some pets to become sick after eating them. The plaintiffs blamed the jerky treats for the illness and death of more than 1,000 pets.
Nestle Purina PetCare Company and Waggin’ Train LLC, the manufacturers of the allegedly defective jerky treats, deny any wrongdoing but agreed to settle the dog treat class action lawsuits to avoid the cost and expense of trial.
Class Members of the dog treat settlement include anyone who purchased or obtained the affected Waggin’ Train and/or Canyon Creek Ranch dog food products, and anyone whose pets consumed any of the dog treat products imported from China or containing any ingredient imported from China.
Under the terms of the dog treat class action settlement, Class Members who submitted timely and valid claims were eligible to receive up to a 100 percent cash payment for documented, reasonable economic damages incurred as a result of their purchase or their pet’s consumption of the allegedly defective dog treat products. Class Members without documentation could claim up to $300 per pet, subject to a pro rata reduction and other limitations.
The deadline to file a claim for the dog treat class action settlement passed on April 1, 2015. The settlement was given final approval on June 23, 2015, but was subject to an appeal. Now that the appeal has been dismissed, the settlement administrator will begin preparations for disbursing payments to Class Members who submitted valid and timely claims.
