Xarelto Lawsuit Claims Man Suffers Brain Bleed

xarelto internal bleedingA Xarelto lawsuit claims the blood thinner caused a life-threatening brain hemorrhage after the plaintiff took the drug for three months.

Plaintiff Glen S. filed a Xarelto lawsuit against pharmaceutical giants Bayer Healthcare, Johnson & Johnson, as well as its subsidiary Janssen Pharmaceuticals, for allegedly negligently misrepresenting the anticoagulant as a safe and effective medication.

According to the lawsuit, Xarelto’s manufacturers conducted marketing campaigns to promote the sale of Xarelto and “willfully deceived” patients, along with physicians and the general public, regarding the consequences of taking Xarelto.

The Xarelto lawsuit claims that by advertising Xarelto direct to consumers, patients began requesting prescriptions of the new blood thinner. The lawsuit alleges that the marketing of Xarelto “failed to disclose the need for dose adjustments, failed to disclose the need for blood monitoring, and failed to adequately disclose to patients that there is no drug, agent, or means to reverse the anticoagulation effects of Xarelto, and, that such irreversibility could have permanently disabling, life-threatening and fatal consequences.”

The Xarelto bleeding lawsuit alleges that in 2013 manufacturers spent at least $11 million on Xarelto advertising in the U.S. alone. Plaintiff Glen claims that as a result of the direct-to-consumer campaign, Xarelto reached “blockbuster status” with sales reaching $2 billion that year.

Plaintiff Glen states that this “outrageous conduct” should award him punitive damages, which is a financial award large enough that it is designed to “punish” the defendant.

Xarelto Bleeding Side Effects

The U.S. Food and Drug Administration approved Xarelto in 2011 as a blood thinner designed to treat atrial fibrillation patients and is commonly prescribed to patients to prevent blood clots after hip or knee surgery.

Manufacturers promoted Xarelto as a more convenient blood thinner when compared to Warfarin (Coumadin), which has been on the market for more than 50 years. Unlike Warfarin, Xarelto consumers were assured that there is no need for dietary restrictions or regular blood monitoring.

However, patients like Glen who suffered a bleeding event claim they were not warned that should they experience a bleed there would be no way to get it under control.

Warfarin consumers can be given a dose of vitamin k to get bleeding under control, but Xarelto patients are forced to undergo multiple blood transfusions and lengthy hospital stays because the only known way to stop the internal bleeding is to get the drug out of the system.

In its short time on the U.S. market, Xarelto has been named in thousands of FDA adverse event reports, many of those claiming the drug caused a hemorrhage-related death.

Xarelto Multidistrict Litigation

In March an order was issued that makes it unnecessary for plaintiffs to have to file an Xarelto lawsuit into a local district to wait to be transferred to the Xarelto MDL centralized in Louisiana.

Plaintiff Glen is one of hundreds who have joined the Xarelto MDL hoping to receive financial compensation from the manufacturers for allegedly failing to warn of the potentially severe Xarelto internal bleeding complications.

The Xarelto Bleeding Lawsuit is In re: Xarelto (Rivaroxaban) Products Liability Litigation, Case No. 2:15-cv-05992-EEF-MBN and MDL No. 2592 in the U.S. Court for the Eastern District of Louisiana.
