Big Rivers Asks to be Dismissed from Asbestos Exposure Case

asbestos fibersBig Rivers Electric Corp. has asked to be released from an asbestos lawsuit filed against several companies alleging that a woman’s mesothelioma was caused by her husband’s asbestos exposure at work.

Plaintiff Doris W. filed an asbestos lawsuit against Big Rivers, General Electric, Alcoa, Triangle Insulation & Sheet Metal Co., Indianapolis Light and Energy, Goodrich, Goodyear Tire and Rubber and other companies in October 2014.

Doris alleged that her mesothelioma was caused by the asbestos fibers she was exposed to that were embedded in her former husband’s clothing as she washed his clothes.

Ronald E., Doris’ husband at the time, worked as a union insulator at various plants including Big Rivers in Owensboro, Kentucky during the 1970s and 1980s. Doris divorced Robert in 1985 but court documents stated that he developed an asbestos-related disease called asbestosis and filed his own lawsuit in 1996.

Big Rivers claims that the company did not have a duty to warn Doris because she was not an employee at their facility and because the company was unaware at the time Robert worked at the plant that asbestos dust could be dangerous to spouses.

Asbestos Exposure

Asbestos is a naturally occurring mineral that is found in mountain and hill areas. Asbestos mining was common before the dangers of asbestos were known, but no U.S. asbestos mines are currently in operation. Living near an asbestos mine, however, may still cause asbestos exposure.

Left alone, asbestos typically does not cause much harm. It is only when asbestos is disturbed and the particles become airborne that a real danger is present. The fibers are inhaled and can lead to serious health issues.

The side effects from asbestos exposure can take decades to develop, usually between 20 and 50 years. Because of the long span between exposure and onset of symptoms, many people may not connect the two events.

Diseases Associated with Asbestos Exposure

Three of the main diseases that can result from asbestos exposure are lung cancer, mesothelioma and asbestosis.

  • Lung Cancer: Inhaling asbestos fibers can affect the lungs, causing abnormal cell growth. Lung cancer is often used interchangeably with mesothelioma when talking about asbestos exposure, but the two cancers affect different areas of the body.
  • Mesothelioma: Mesothelioma is a type of cancer that specifically affects the mesothelial cells in the body that line the chest and abdominal cavities. This kind of cancer is almost exclusively caused by asbestos exposure.
  • Asbestosis: As asbestos is inhaled, the lungs become irritated and flamed, and scar tissue can form. The body cannot get rid of asbestos fibers, so they cause further lung irritation and scar tissue development. As scar tissue builds in the lungs, their ability to contract and expand are compromised, leading to breathing difficulty and oxygen deprivation.
