Last week, readers of Top Class Actions began reporting that they were receiving Charming Charlie vouchers in the mail.
These Charming Charlie vouchers were offered as part of a class action settlement over allegations the retailer requested and recorded the personal information of customers who made purchases with a credit card, in violation of California law.
On Jan. 7, readers began reporting they were receiving vouchers worth about $25 from the Charming Charlie class action settlement:
The Charming Charlie settlement resolves a class action lawsuit filed in July 2014 by plaintiffs Heidi Anderson-Butler and Paul Haug. They alleged Charming Charlie requested their personal identification information, such as their addresses and/or telephone numbers, when they used a credit card to make a purchase at a California Charming Charlie store.
Anderson-Butler and Haug alleged that they were made to believe that they were required to provide this personal identification information in order to complete the transaction. The Charming Charlie class action lawsuit accused the retailer of violating California’s Song-Beverly Credit Card Act of 1971, which prohibits merchants from collecting personal identification information as part of a credit card transaction.
Charming Charlie denies any wrongdoing but agreed to settle the class action lawsuit to avoid the risk and expense of trial. The Charming Charlie class action settlement received preliminary approval on July 29, 2015.
Under the terms of the class action settlement, Charming Charlie agreed to provide Class Members with a total of $350,000 in Charming Charlie merchandise vouchers. These Charming Charlie vouchers are redeemable for merchandise at California Charming Charlie stores.
Class Members of the Charming Charlie class action settlement included all customers who, between July 9, 2013 and July 29, 2015, used a credit card to make a transaction at a California Charming Charlie store, and whose persona identification information was requested and recorded by a Charming Charlie employee for purposes other than shipping, delivery or special orders.
The deadline to file a claim for the Charming Charlie class action settlement passed on Oct. 12, 2015.
