CVS Pharmacists Unpaid Overtime Class Action Settlement

A settlement has been reached in a class action lawsuit over allegations some CVS pharmacists in California’s Region 60 worked more than six consecutive days without being paid overtime.

The CVS unpaid overtime class action lawsuit (Angil Sharobiem, et al. v. CVS Pharmacy Inc., et al.) asserts the following claims: (1) failure to pay overtime; (2) failure to provide accurate itemized statements; (3) waiting time penalties; (4) conversion; (5) unfair business practices; and (6) penalties under the Private Attorneys General Act.

According to the CVS class action lawsuit, pharmacists who work more than six days in a row are entitled to overtime pay for work beyond the sixth day, regardless of how CVS defines its work week.

This class action settlement pertains only to Region 60. Similar settlements have already been reached with CVS pharmacists in Regions 54, 65, 74, and 73.

CVS denies the allegations but agreed to settle the class action lawsuits to avoid the expense and uncertainty associated with ongoing litigation.

Who’s Eligible

The CVS Settlement Class is defined as “All persons who are or were employed by CVS as non-exempt pharmacists in Region 60 in the State of California, and who worked more than six consecutive days of work without overtime pay from November 6, 2009, through April 30, 2015.”

Potential Award

Varies.

CVS will pay more than $2.9 million to resolve the litigation. Class Members will be paid based on the number of workweeks in which they worked more than six consecutive days without overtime pay during the Class Period.

Class Members should have received a notice in the mail that lists the amount they are expected to receive from the CVS unpaid overtime settlement. If you did not receive a notice but believe you qualify as a Class Member, contact the Settlement Administrator at 1-866-545-7415.

N/A. Eligible Class Members who do not opt out of the settlement will automatically be mailed a check if the settlement becomes final.

Class Members who wish to opt out of the CVS settlement must submit a Request for Exclusion Form no later than Feb. 22, 2016.
