An Arizona woman has filed an Essure lawsuit against Bayer, alleging that she suffered personal injury as a result of the medical device.
Plaintiff Katherine S. had the Essure birth control implant placed in July of 2008. Following the procedure, Katherine claimed to have experienced severe constant daily pain as well as severe bleeding.
In addition, Essure lawsuit states that she also experienced migraines, mental and emotional anguish as a result of her situation.
To control her heavy bleeding, Katherine underwent a uterine ablation to control the heavy bleeding in January 2015. It wasn’t until that same year that Katherine found that other women experienced similar issues as a result of the Essure birth control implant through her internet research.
Katherine brought forth 10 counts against Bayer, including manufacturing defect, design defect, negligence, failure to warn, strict liability, breach of implied warranty, breach of express warranty, negligent misrepresentation, fraudulent misrepresentation and fraud by concealment.
In terms of compensation for her medical issues allegedly caused by her birth control implant, Katherine is seeking past and future general, economic and special damages, loss of earning and impaired earning capacity, past and future medical expenses as well as pain and suffering damages, equitable relief, medical monitoring, punitive or exemplary damages, costs of litigation and a declaratory judgment that the defendants are liable for all future evaluative, monitoring, diagnostic, preventative and corrective medical, surgical and incidental expenses, costs, and losses caused by their alleged wrongdoing.
The Essure Lawsuit is Case No. 5:15-cv-04952-NC in the U.S. District Court for the Northern District of California, San Francisco Division.
Essure Permanent Birth Control
Essure is a form of non-hormonal female sterilization and it is a form of permanent birth control. Essure consists of a birth control implant made from metal coils and polyethylene fibers that is inserted into the fallopian tubes by a physician using a small camera during an outpatient procedure.
In time, tissue begins to grow around the birth control implant, causing a physical barrier to develop that will not allow sperm to reach the eggs, thereby preventing pregnancy.
Three months after a woman has the Essure permanent birth control device implanted, she goes back to the physician who will perform a “confirmation test.” During the test, the physician checks to make sure that the birth control implant is in the right location and that the tissue around the implant has created a complete barrier.
Essure Birth Control Implant Complications
While Bayer has claimed that Essure is safe and effective, many women have reported negative experiences with the device. The most commonly reported adverse events include:
- Abdominal pain
- Abnormal bleeding
- Bloating
- Cramping
- Device expelled from original location
- Device perforated internal organs
- Dizziness or lightheadedness
- Fainting
- Headaches and migraines
- Heavier periods
- Hypervolemia (fluid buildup in blood)
- Pain in the back, leg and arm
- Painful intercourse
- Vaginal discharge and infection
- Vomiting
Reversal of the sterilization with Essure is not possible, and the only way some women have been able to address the issues allegedly caused by the device is to undergo a complete hysterectomy.
However, hysterectomy can lead to more issues for some women, such as incontinence, pelvic organ prolapse, scar tissur formation in the pelvic organs, bowel dysfunction and sexual problems.
