An Alabama resident recently filed an Unum bad faith insurance lawsuit against Unum Life Insurance, alleging that the company denied her legitimate disability insurance claim.
The plaintiff, Theresa H., was insured under a Unum Life Insurance long term disability policy through her employer, BLG Logistics, Inc.
Theresa filed a claim for disability benefits according to her employee benefit plan after being diagnosed as being disabled and no longer able to work full time.
Unum initially approved the plaintiff’s disability claim, paying long term disability benefits for about a year long period. However, in March 2015, Unum stopped paying the plaintiff’s long term disability benefits.
Theresa immediately responded by requesting an administrative appeal in light of this decision, which was denied shortly thereafter.
Theresa’s Unum bad faith insurance lawsuit alleges that Unum’s denial is based off of arbitrarily procured evidence.
According to the bad faith insurance lawsuit, Unum used outdated and irrelevant evidence to support their claim and neglected to perform the necessary inquiry to determine the validity of Theresa’s long term disability insurance claim.
