Montana County Settles Former Janitor’s Asbestos Lawsuit for $650K

lung-cancer-congressThe family of a man who died from mesothelioma in July was recently awarded $650,000 in a settlement from Yellowstone County after he was exposed to asbestos working as a janitor at the county courthouse.

News sources report that Lauren D. worked as a contractor janitor for Automated Maintenance Services Inc. from 1987 to 1999, which included duties in the county courthouse.

It was during that time the he was “harmfully exposed to asbestos-containing products utilized in the Yellowstone County Courthouse during his tenure there,” the asbestos lawsuit states.

In 2014, Lauren was diagnosed with malignant mesothelioma. The development of mesothelioma can only occur from asbestos exposure.

Shortly after his diagnosis, he filed an asbestos lawsuit against Yellowstone County for “reasonable compensation,” which included medical costs associated with his illness, pain, suffering, emotional distress, and the loss of enjoyment of life.

Unfortunately, Lauren died in July, just as mediation for his case started, but his asbestos attorneys continued the case for him on behalf of his estate.

According to the asbestos a lawsuit, “as a direct and proximate result of exposure to asbestos contained in (Yellowstone County’s) facilities, [Lauren] contracted mesothelioma and became permanently disabled.”

With the help of a case mediator, the city was able to come to an agreement with Lauren’s attorneys, and $650,000 was given to the former janitor’s estate.

Occupational Risk of Asbestos

Although Lauren served as a janitor during the years in which asbestos wasn’t used, the toxic mineral was used to create numerous buildings that are still in use today, including the Yellowstone County.
