Some of our readers have let us know that they received a second payment from a class action settlement, getting their 2016 off to a great start!
On Jan. 11, Class Members who submitted claims for the Wilkins v. HSBC Bank class action settlement began reporting that they were receiving checks worth $7.15, in addition to the payment they initially received from the settlement last year.
These HSBC Bank settlement checks stem from the class action lawsuit titled Wilkins v. HSBC Bank Nevada NA, which alleged HSBC employed an automatic telephone dialing system to place pre-recorded messages or robocalls to consumers’ cell phones, in violation of the Telephone Consumer Protection Act (TCPA).
HSBC denies any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the expense and uncertainty of going to trial. Under the terms of the TCPA class action settlement, HSBC agreed to pay nearly $40 million to resolve the litigation.
Class Members of the HSBC settlement include all individuals within the United States who received a non-emergency call on their cell phone from HSBC Card Services Inc., or any third-party group on behalf of HSBC Finance Corp. or HSBC Bank Nevada, between May 31, 2008 and May 1, 2012, and the call used an automatic telephone dialing system or prerecorded voice.
The deadline to file a claim for the HSBC class action settlement passed on Nov. 4, 2014.
The first round of checks for the HSBC class action settlement was mailed on May 22, 2015. Readers of Top Class Actions reported that they received checks worth about $102 from the settlement.
According to a post in the Frequently Asked Questions sections of the settlement website, “Class Members who cashed their initial distribution check before the stale date were mailed a second and final payment of $7.15 on January 8, 2016.”
