Talcum Powder Cancer Lawsuits Consolidated in New Jersey Court

Baby talcum powderThe talcum powder ovarian cancer litigation movement has been recently centralized in a New Jersey State Court, after the state’s Supreme Court decided to consolidate the similar product liability claims.

Each of the baby powder lawsuits claim that  Johnson & Johnson’s talcum powder products, including their baby powder or Shower to Shower powder, had caused them or their loved ones to develop ovarian cancer.

In recent years, the number of filed talcum powder ovarian cancer claims have risen from women who had been allegedly hurt from the products.

In a Notice letter to the Bar issued on Nov. 25, 2015, it was announced that these baby powder cancer lawsuits would be centralized under Judges Julio L. Mendez and Nelson C. Johnson in Atlantic County, as part of a multicounty litigation (MCL).

The consolidation had been decided after Johnson & Johnson requested the action, with over 100 talcum powder ovarian cancer lawsuits pending throughout the state.

Overview of Talcum Powder Ovarian Cancer Allegations

This litigation movement involves over 156 plaintiffs, with most of the cases being originally filed in Atlantic County. Consolidating these baby powder cancer lawsuits helps conserve litigation resources, prevent duplicate discovery, and helps avoid conflicting rulings.

Each of these baby powder lawsuits allege that Johnson & Johnson failed to provide sufficient warnings about the possibility of ovarian cancer when using their talcum powder products. More specifically, the label reportedly fails to warn women from using the talcum powder for a specific hygienic purpose.

While talcum powder has been a staple baby product for generations, it has been recently discovered that major complications can arise for women using who use it on their genital area.

Women often apply talcum powder to that area to treat yeast infections, odor, or moist skin. When applied to that area, the talc particles are reportedly able to travel up through the fallopian tubes and embed themselves into the ovaries.

These particles can remain in position for up to eight years and are allegedly able to fester into cancer cells and cause potentially fatal consequences to women. Since the 1970s, scientists have been concerned over the possibility of talcum powder ovarian cancer.

These claims cite various studies indicating the potential association between ovarian cancer and talcum powder. A small group of cases will be selected as part of coordinated pretrial proceedings, each of which will be prepared for early trial dates.

These baby powder lawsuits will help the parties determine how the juries may react to certain evidence and testimony that is likely to be repeated throughout the litigation. While the outcome of these early trials will not influence other baby powder cancer lawsuits, they could influence potential talcum powder ovarian cancer settlements.

If a settlement is not reached after the conclusion of the last bellwether trial, Johnson & Johnson could potentially face hundreds of individual talcum powder lawsuits.
