Unum Life Insurance Company of America is facing a claim denial lawsuit from a man in North Carolina who claims he was denied his disability insurance benefits.
The man claimed that he qualified for those Unum benefits after becoming unable to work from a severe disability.
Plaintiff Jimmy Y. was employed by Illinois Tool Works until 2012, and was provided with long term disability coverage from Unum.
The disability insurance company was solely in charge of determining whether or not Jimmy was eligible for Unum benefits and had the civil responsibility of acting in the best interest of its policyholder, according to the Unum lawsuit.
This disability insurance had become crucial for Jimmy in 2012, as he needed the income protection after becoming disabled. Jimmy was forced to cease working and filed for Unum benefits but had been met with a claim denial.
Overview of Unum Claim Denial Allegations
At the time he had filed for disability benefits, Jimmy claims he followed all administrative procedures and met all required deadlines. Jimmy’s Unum lawsuit indicates that he filed all paperwork accordingly, and had submitted medical testimony from his physician stating that he could not longer work due to his disability.
Additionally, his disability is not a pre-existing condition and he will be unable to work in any similar occupation due to this infraction, according to the complaint. Jimmy’s income level has also experienced as significant drop and he has been unable to work since becoming disabled.
Jimmy appealed Unum’s denial a second time, but was met with the same negative result as his first claim denial. According to the lawsuit, Unum had denied his disability benefits under bad faith insurance circumstances and other unethical practices. Unum had reportedly relied on insufficient evidence or biased opinions, when looking over his disability claim, according to statements in the lawsuit.
Therefore, Jimmy allegeed that the insurance company acted in its own best interest and had denied his claim under illegal circumstances. At this point, Jimmy claims he needs the disability insurance to maintain a certain level of living and has exhausted all administrative remedies to claim his Unum benefits.
Jimmy is seeking compensation for all missed disability insurance payments, and request for a “full and fair” review by an appropriate Unum representative.
