A Texas man filed a Benicar lawsuit against Daiichi Sankyo after suffering from multiple medical complications linked with the popular hypertension drug.

The plaintiff was prescribed and began using Benicar in 2002. As a result of ingesting Benicar, the plaintiff has suffered from intestinal and/or colonic disease manifestations.

This has led to multiple complications, including chronic diarrhea, weight loss, nausea, vomiting, abdominal pain, and other symptoms. The plaintiff has also suffered from economic losses associated with these complications.

The plaintiff filed this Benicar lawsuit on multiple counts, including but not limited to failure to warn, negligent misrepresentation, fraudulent concealment, breach of express and implied warranties, constructive fraud, and unjust enrichment. The plaintiff seeks punitive damages as a result of his suffering.

Benicar Basics

Benicar (olmesartan medoxomil) is a popular hypertension drug, but has recently been associated with multiple medical complications. These side effects have encouraged a number of lawsuits, claiming the drug is defective, and that the drug manufacturer failed to adequately warn the public and the medical community about the risks involved in taking the drug.

Benicar tablets were first approved by the United States Food and Drug Administration (FDA) to treat hypertension in 2002.

On July 3, 20013, the FDA followed up this approval with a Drug Safety Communication warning that the drug Benicar (olmesartan medoxomil), also marketed as Benicar HCT, Azor, and Tribenzor, can cause medical complications such as sprue-like enteropathy.

Sprue-like enteropathy is a serious intestinal problem which causes such complications as chronic diarrhea, weight gain, and other serious gastrointestinal problems. The FDA approved changes to the label of these drugs that would include warnings about this medical concern.

Olmesartan medoxomil drugs like Benicar have been extremely popular and are widely distributed, which means that millions of people across the United States are at risk of suffering from these kinds of medical complications.

Several studies have shown a connection between olmesartan medoxomil and sprue-like enteropathy, as well as other gastrointestinal problems, including a study published by Mayo Clinic researchers in 2012. Numerous case studies have been published in recent years.

Benicar Lawsuits

Other Benicar lawsuits have claimed that Daiichi Sankyo failed to perform reasonable and necessary prolonged clinical trials to determine the effects of longer term cumulative exposure to olmesartan.

Plaintiffs in these Benicar lawsuits also claim that Daiichi Sankyo has, over the years, marketed their Benicar products in false or misleading ways which omit and/or minimize the potential risks associated with the drug.

The company continued to make claims as to the efficacy of their products, but did not conduct any clinical outcome trials that would prove this efficacy. In contrast, makers of the other ARB drugs available have performed such clinical outcome trials to investigate long-term risks.
