DePuy Hip Lawsuit Alleges Implant is Defective

300 D.P.IAnother hip implant lawsuit joins the mounting multidistrict litigation against DePuy Orthopaedics alleging that the company designed a defective product that releases metal into the blood system and body tissues.

Plaintiff MaryAnn M. of Oregon filed the DePuy hip implant lawsuit after being implanted with an allegedly faulty ASR system.

MaryAnn claims that after undergoing hip replacement surgery she began feeling pain, anxiety and had limited mobility. The metal-on-metal hip implant lawsuit claims that when metal was found in her bloodstream MaryAnn was advised to undergo a second surgery to remove the reportedly defective product.

According to the DePuy lawsuit, plaintiff MaryAnn will continue to suffer from hip replacement complications including economic loss and permanent personal injuries. She is suing DePuy as well as Johnson & Johnson for fraudulent concealment, negligent misrepresentation, breach of warranty and negligence.

Hip Implant Complications

The DePuy hip implant was approved by the U.S. Food and Drug Administration under section 510(k) which means that manufacturers informed the federal agency that the design was “substantially equivalent” to other hip products already on the market. In other words, the hip implant was “grandfathered” in by using the premarket approval process.

Since its release, the FDA has received more than 1,300 reports of severe hip implant side effects including:

  • Cobalt poisoning
  • Chromium or cobalt leaking into bloodstream
  • Metal poisoning
  • Loss of bone strength
  • Tissue death
  • Non-cancerous tumors around implant
  • Heart disease
  • Cancer

By 2010, DePuy voluntarily recalled more than 93,000 ASR hip implants worldwide.

Hip Implant Lawsuits

More than 500,000 U.S. residents have undergone hip replacement surgery hoping for an improved lifestyle. Thousands of patients have already filed hip replacement lawsuits over allegations that the metal-on-metal hip implants are defective and cause severe complications.

Numerous lawsuits have been filed against DePuy and Johnson & Johnson for their ASR hip implants.
