Dynamic Accident Lawyers: Alma Lasers TCPA Class Action Settlement

A class action lawsuit alleging that Alma Lasers violated the Telephone Consumer Protection Act (TCPA) and FCC regulations has recently reached a settlement in the amount of $4.5 million. The TCPA lawsuit claimed that Alma Lasers sent unsolicited advertisements via fax.

Plaintiff Physicians Healthsource Inc., on behalf of itself and others similarly situated, filed a class action lawsuit claiming that the company had received three faxes in July and August 2008 in promotion of an Alma seminar that was to take place in October 2008. According to the plaintiff, these faxes were sent without prior consent, in violation of the TCPA.

Alma Lasers has denied any wrongdoing in association with the claims brought forth against the company and has not admitted fault or liability in association with the settlement. The lead plaintiff in the class action lawsuit and Alma Lasers reached an agreement to settle the claims in an effort to avoid the cost and risks of allowing the case to continue to go on to trial.

The Settlement Administrator faxed a notice or mailed out a postcard notice to individuals who are potential Class Members based on a list of fax numbers where advertisements may have been sent by fax.

The settlement was given preliminary approval on Dec. 3, 2015.

Who’s Eligible

The Settlement Class includes “All persons who between May 18, 2008 and November 13, 2015 were sent telephone facsimile messages of material advertising the commercial availability of any property, goods, or services by or on behalf of the Alma Lasers, Inc.”
