The Benicar lawsuit is just one of many claims that have recently been filed against the defendants.
The Benicar lawsuits allege that the company failed to warn the medical community and the general public about dangerous risks associated with using the medication.
The most recent Benicar lawsuit was filed by plaintiffs Gail S. and her husband Craig S. Gail and Craig are residents of Keller, Virginia. According to their Benicar lawsuit, Gail began taking Benicar in February 2003 after being prescribed the medication by her treating physician.
While taking Benicar Gail began to experience serious gastrointestinal injuries. Her injuries included colon and intestinal disease manifestations which caused Gail to experience diarrhea, vomiting, nausea, abdominal cramping, and several other adverse symptoms. Due to the symptoms Gail required hospitalization where she underwent screening, testing, and treatment.
Gail is asserting claims of negligence, products liability, fraudulent concealment, breach of warranty, unjust enrichment, and several other claims. Her husband Craig joined the Benicar lawsuit as a co-plaintiff in order to bring a claim for loss of consortium, also known as the loss of spousal intimacy.
Loss of consortium claims cannot be brought on their own and must be joined with other claims. Gail and Craig are asking for both compensatory and punitive damages.
The Benicar lawsuit was filed as part of the multidistrict litigation against Forest Laboratories and Daiichi Sankyo. Multidistrict litigation sometimes occurs when multiple lawsuits are filed against the same defendant that share similar facts and questions of law. These lawsuits are funneled before a single judge for pretrial and discovery motions. This helps create consistency among pretrial rulings.
In some cases a judge will initiate bellwether trials where a few of the lawsuits are tried early. This helps initiate settlement talks between the parties as the learn the potential value of their cases.
What is Benicar?
Benicar, generically known as olmesartan, is a popular medication used to treat high blood pressure. In 2013 the US Food and Drug Administration released a drug safety warning that informed consumers that Benicar could cause an intestinal problem known as sprue-like enteropathy. Symptoms of sprue-like enteropathy include electrolyte imbalance, substantial weight-loss, and severe or chronic diarrhea.
In many cases, symptoms do not develop until months or years after the victim began taking Benicar. This causes many patients to not realize the cause of their symptoms which can lead to delayed or misdiagnosis.
While the symptoms of sprue-like enteropathy generally end once the patient stops the medication, some patients experience permanent intestinal damage. The permanent damage can occur to the villa of the intestinal track and is sometimes mistakenly associated with celiac disease.
The Benicar Lawsuit is Case No. 1:15-cv-06448-RBK-JS, filed in the United States District Court in the District of New Jersey, Camden Vicinage.
