A plaintiff from Oklahoma has joined the Xarelto multidistrict litigation, representing himself and the estate of his late spouse.

Plaintiff Sheldon M. says that his late spouse David started taking Xarelto in November 2012. The next April, David allegedly suffered a hemorrhage that took his life. Sheldon attributes David’s hemorrhage and subsequent death to his course of Xarelto.

Sheldon is now suing Janssen Pharmaceuticals, Johnson & Johnson, Bayer Corporation, and their related companies, all of whom he says are involved in the manufacture or distribution of Xarelto.

Xarelto is an anticoagulant medication made by Janssen Pharmaceuticals, a subsidiary of Johnson & Johnson. It’s also known by its generic name rivaroxaban.

According to Sheldon’s Xarelto lawsuit, the FDA granted initial approval for Xarelto in July 2011 to reduce the risk of blood clots, deep vein thrombosis, and pulmonary embolism.

In November 2012, additional approval was granted to use Xarelto as a treatment for existing pulmonary embolism and deep venous thrombosis, and as a long-term treatment to prevent those conditions from recurring.

Sheldon alleges that the defendants failed to properly alert physicians and patients about the risk of Xarelto bleeding. He says that David would not have used Xarelto if the defendants had properly disclosed the risks associated with its use.

The Xarelto lawsuit refers to a promotional website for Xarelto that promotes the drug as not requiring regular blood monitoring or dietary restrictions. He says the website also promotes Xarelto as needing only once-daily dosing.

Sheldon alleges that through this website and other marketing materials, the defendants misled patients and physicians as to the need to monitor any patient taking a blood thinning agent.

The plaintiff says that in June 2013 the FDA sent defendants a letter challenging a print ad for Xarelto that appeared in the January/February issue of WebMD magazine. The FDA said that the ad was “false or misleading because it minimizes the risks associated with Xarelto® and makes a misleading claim,” Sheldon says.

The FDA also took issue with the ad’s statement “And there are no dosage adjustments,” which apparently conflicted with Xarelto’s FDA-approved labeling, according to Sheldon.

Sheldon is seeking compensation to cover medical and other expenses, the loss of the prospective income to David’s estate, and an award of punitive damages. Sheldon is also asking the court to award damages reflecting the loss of his relationship with David, including companionship, support and services, as well as Sheldon’s own mental pain and suffering that followed from David’s illness and death.

Sheldon’s claim is part of the Xarelto multidistrict litigation that is now going on in a federal court in Louisiana. This multidistrict litigation, or MDL, is a consolidation of several individual Xarelto lawsuits before a single judge, who oversees pretrial procedures.

The federal court system uses the MDL procedure to more efficiently handle large numbers of similar claims, such as occur often in large-scale pharmaceutical products liability litigation.

The Xarelto Bleeding Lawsuit is Case No. 2:15-CV-01059-EEF-MBN and MDL No. 2592 in the U.S. District Court for the Eastern District of Louisiana.
