A settlement has been proposed in a class action lawsuit alleging Oxnard Automobile Exchange Inc. and Access Finance Inc. (formerly known as Trifish Finance Inc.) used tracking devices to locate vehicles in violation of California law.
If you purchased a vehicle in California after May 13, 2009 that was financed by Access Finance Inc. or Trifish Finance Inc., and the vehicle was equipped with an electronic tracking device that allowed the companies to locate the vehicle, you may be entitled to benefits from this class action settlement.
The defendants deny any wrongdoing and claim that they did not track vehicles for an improper purpose. However, they have agreed to a class action settlement to avoid the expense and uncertainty of ongoing litigation.
The auto tracking device class action settlement was preliminarily approved on Dec. 15, 2015.
Under the terms of the proposed class action settlement, the defendants will compensate eligible Class Members for the cost of inspection and removal of any tracking device found in their vehicles.
Who’s Eligible
You are a Class Member of the California auto tracking settlement if you purchased a vehicle in California after May 19, 2009 that was financed by Access Finance Inc. or Trifish Finance Inc., and the vehicle was equipped with an electronic tracking device that allowed the companies to locate the vehicle.
If you received a mailed notice of this class action settlement, then the defendants have identified you as a Class Member.
Potential Award
Up to $5,000. The settlement fund will be distributed on a pro rata basis and the amount each claimant will receive depends on how many eligible Class Members file claims.
Proof of Purchase
Class Members must provide the 8-digit Claim ID Number that was listed on the mailed notice. If you are unable to locate your Claim ID Number, contact the Settlement Administrator.
Class Members will be asked to verify their contact information, proof of vehicle purchase, and proof that Access Finance Inc. or Trifish Finance Inc. was the applicable finance company for the subject vehicle.
