A settlement has been reached in a class action lawsuit alleging Nationwide Credit Inc. violated the Fair Debt Collection Practices Act by sending collection letters that misleadingly state the law regarding a requirement to file certain forms with the Internal Revenue Service.
If you have a Pennsylvania address and were sent one or more letters from Nationwide Credit stating that GE Capital Retail Bank, Synchrony Bank or American Express “is required to file a form 1099C with the Internal Revenue Service for any cancelled debt of $600 or more” (or a substantially identical statement), and the letters were mailed between July 16, 2013 and July 1, 2015, you may be entitled to payment from this FDCPA class action settlement.
The Nationwide Credit FDCPA class action lawsuit alleged that Nationwide Credit violated the law by sending collection letters that deceptively include statements about the 1099C forms that are improper under the Fair Debt Collection Practices Act.
Nationwide Credit denies the allegations but agreed to settle the FDCPA class action lawsuit to avoid the expense and uncertainty of ongoing litigation. Under the terms of the proposed class action settlement, Nationwide Credit will pay a total of $196,960 to resolve the litigation.
Class Members who wish to exclude themselves from this class action settlement must do so no later than Jan. 13, 2016.
Who’s Eligible
Class Members of the FDCPA settlement include:
“All persons with addresses in the Commonwealth of Pennsylvania, who were sent one or more letters from Defendant Nationwide, that stated GE Capital Retail Bank, Synchrony Bank, or American Express ‘is required to file a form 1099C with the Internal Revenue Service for any cancelled debt of $600 or more,’ or a substantially identical statement, where the underlying debt being collected was incurred primarily for personal, family or household use, the letter(s) bear(s) a send date from July 16, 2013 through July 1, 2015, and the letter(s) were not returned as undeliverable.”
Potential Award
Approximately $12.93.
Payments from the Nationwide Credit class action settlement fund will be made on a pro rata basis to Class Members who do not opt out. It is estimated that each Class Member will receive a payment of $12.93.

N/A. If you received notice of this Nationwide Credit class action settlement and you do not file a timely request for exclusion, you will automatically be mailed a payment if the settlement becomes final.
Exclusion requests must be postmarked no later than Jan. 13, 2016.
