A New Mexico plaintiff has filed a DePuy hip implant lawsuit, alleging that a defective DePuy device caused him severe bodily injury and pain.
The plaintiff, Jesus G., underwent total left hip replacement surgery in 2009. He was implanted with the DePuy Pinnacle Acetabular Cup System hip implant device.
Shortly afterwards, Jesus began experiencing problems with the device. He felt clicking and grinding within his hip and was suffering from constant pain. Jesus had to go through two revision surgeries in 2014 in an attempt to correct this problem.
Jesus’ DePuy hip lawsuit alleges that DePuy concealed their device’s defects and its failure rate, as well as the risks associated with the product. Had the company adequately disclosed these unreasonable risks, Jesus claims he would not have had the DePuy hip implant inserted into his body, and therefore, he could have avoided significant physical and economic harm.
Jesus is charging DePuy with failure to warn, defective design, inadequate testing, negligent misrepresentation, fraud, and several others.
According to the metal hip implant lawsuit, in failing to warn Jesus and others of the dangers of the DePuy Pinnacle Acetabular Cup System, DePuy exposed Jesus to significant damages.
Because of DePuy’s actions and inactions, Jesus alleges he suffered from permanent physical injury, including loss of mobility and loss of range of motion. Jesus also claims to have suffered from economic loss and physical and emotional pain and suffering.
Because of the alleged defectiveness of the DePuy Pinnacle Acetabular Cup System, Jesus has needed multiple surgeries to repair his physical injuries. This placed the plaintiff at risk of further complications and even death.
Metal-on-Metal Hip Implants
Most metal-on-metal hip implant systems have been abandoned, replaced by updated versions that include metal on polyethylene components, or other synthetic materials.
Metal-on-metal hip implants can come with severe complications. These devices, including the DePuy Pinnacle Acetabular Cup System, have a high failure rate, and can also reportedly release highly toxic metal ions into a patient’s tissue and bloodstream. Particles released from the metal-on-metal hip implant devices can also cause metallosis, tissue death, and tumor growth.
The DePuy hip implant systems have already been taken off the Australian market because of its early and high rate of failure.
DePuy Hip Implant Lawsuits
According to Jesus’ DePuy hip lawsuit, there have been approximately 150,000 DePuy Pinnacle Acetabular Cup Systems implanted.
The DePuy metal hip replacement lawsuit also claims over 1,300 adverse reports have been submitted to the Food and Drug Administration (FDA) regarding failures of the DePuy Pinnacle Acetabular Cup System.
DePuy claims in its advertising that 99.9 percent of these devices are still in use.
According to DePuy hip implant lawsuit, DePuy actively concealed their knowledge of these numerous and serious complications during such meetings.
The metal hip implant lawsuit alleges that DePuy had material knowledge that its metal-on-metal hip systems, including the DePuy Pinnacle Acetabular Cup System, were defective and therefore not safe prior to selling the product.
Instead of recalling the allegedly defective product, DePuy continued to market the hip implant system as safe and effective to maintain sales, according to the lawsuit.
The plaintiff alleges that DePuy is apparently more concerned with their sales revenue and corporate profits than patient safety.
