Consumer protection attorneys are currently looking for potential plaintiffs to bring credit card lawsuits against various retail companies for violations of the Fair and Accurate Credit Transaction Act (FACTA).
FACTA requires that merchants follow very specific rules and regulations in order to protect consumers from fraud or identity theft.
FACTA works to protect consumers by preventing third parties from being able to piecemeal together a customer’s credit card information based off of a merchant receipt.
FACTA addresses issues of privacy, accuracy, limits on information sharing, and consumer rights to the disclosure of their information. The federal law was passed in 2003 by Congress in an effort to address the growing issue of identity theft.
Merchants violate FACTA rules and regulations by including any portion of a consumer’s credit card expiration date on the receipt or by including more than the last five digits of the credit card number on the receipt.
Instead of including the consumer’s entire credit card number on the receipt, merchants should represent the numbers with symbols such as * or #. However, when these rules are not followed, it leaves customers at risk for identity theft or credit card fraud.
FACTA regulations apply to all electronically printed receipts, whether or not the receipt is printed at a restaurant, self serve kiosk, or a cash register. If a merchant violates a consumer’s FACTA rights, the consumer may file FACTA lawsuit against the merchant for willfully or negligently violatating federal consumer protection laws.
