A new Essure lawsuit was recently filed in a California federal court against Bayer Pharmaceuticals, alleging the company’s Essure sterilization device is dangerously defective.
Plaintiff Danielle P., a resident of Arizona, filed the Essure lawsuit claiming that Bayer violated consumer protection laws by failing to warn the medical community and general public about side effects associated with the device.
Danielle had the Essure sterilization device implanted by her physician back in 2009. The physician implanted the Essure coils into both Danielle’s right and left fallopian tubes.
Prior to the Essure sterilization procedure, Danielle discussed her birth control options with her implanting physician. Her physician recommended that she choose the non surgical option and have the Essure coils implanted.
According to the Essure lawsuit, once the coils were implanted Danielle began to experience constant pain and severe bleeding. Danielle claims that the implantation of the medication device has caused her to suffer Essure complications which included heavy bleeding, menorrhagia, constant pain, and mental and emotional anguish.
The Essure lawsuit states that Danielle became aware that the permanent birth control device was the cause of her medical problems in 2015. Danielle claims she discovered the connection by researching other women who were suffering from similar symptoms.
Danielle alleges that she never would have chosen to have Essure implanted if she had been fully informed of the potential Essure complications associated with the sterilization device.
What is Essure?
Essure received FDA approval back in 2002. Essure is a popular nonsurgical alternative for women looking for permanent, non hormonal birth control options. The Essure sterilization device consists of two metal and polyester coils that are implanted through the vagina and uterus and placed inside each fallopian tube.
The sterilization device received fast track FDA approval because it was considered a safer non surgical option for women seeking permanent birth control. But since 2002, the US Food and Drug Administration has received over 5,000 adverse event reports in relation to the medical device.
In September, an advisory committee asked the FDA to conduct an investigation after being notified by several women of serious Essure complications including severe pelvic pain and bleeding after having the device implanted.
Essure Lawsuits
Many women have reported Essure complications such as bloating, rashes, allergic reactions, excessive bleeding, organ perforation, pelvic pain, miscarriage, and ectopic surgery.
Women who have been affected by the birth control device are not only asking that the FDA revoke the Essure’s approval and remove the medical device from the market but are filing lawsuits against Bayer.
