Unum Claim Denial Lawsuit Filed by Physical Therapist

A California physical therapist has filed an Unum lawsuit against the disability insurance provider over allegations of bad faith practices.

Plaintiff Arthur K. alleges he carried two insurance policies through Provident Life & Accident Insurance Company (Unum) to help cover his physical therapy business as well as his personal income should he eventually become totally disabled.

The bad faith claim lawsuit states that Arthur’s business overhead insurance policy would provide him with $11,960 per month until a total of $143,520 is reached. In his second policy, Arthur claims that he should have received no less than $15,000 per month.

According to the Unum lawsuit, Arthur’s business employs 50 workers in six different rehabilitation centers. He was allegedly required to drive long hours in between centers and personally perform physical therapy on patients.

However, Arthur was diagnosed with degenerative disc disease and severe bilateral foraminal narrowing in the spine — making it difficult to sit, stand or walk for long periods of time. Although he was treated by epidural injections, he claims that symptoms worsened overtime.

The Provident Life & Accident Insurance Company lawsuit alleges that Arthur did not want to walk away from a profession he had for almost 30 years and was worried that his business would fail but he eventually was deemed to be totally disabled in March 2013.

Plaintiff Arthur states that he received long-term disability benefits between June 2013 until April 2014 when Unum decided to discontinue his benefits despite his continued disability. Arthur says he has exhausted all administrative appeals and was forced into filing the Unum lawsuit in order to obtain benefits that are rightfully his.

The bad faith claim lawsuit alleges Provident Life & Accident Insurance Company is in breach of contract by withholding disability benefits for a valid claim.
