After a mother testified about her son’s Risperdal gynecomastia symptoms, Johnson & Johnson claims that her testimony does not merit the $2.5 million a jury awarded to the family.
According to Janssen Pharmaceuticals, the unit of Johnson & Johnson involved in this Risperdal lawsuit, the mother’s story is not enough to merit such a hefty jury award. Janssen Pharmaceuticals said in a brief that the testimony was the sole basis for the award, and that the amount should be reduced.
The family of Austin P. filed the Risperdal gynecomastia lawsuit against Johnson & Johnson after Austin developed distressing gynecomastia symptoms as a teenager. Gynecomastia is the growth of breast tissue in males.
According to the family’s Risperdal lawsuit, Austin’s gynecomastia is the direct result of a 5-year treatment with Risperdal. The treatment began in 2002, when Austin was just 7 years old.
When the autistic boy’s treatment began, the Food and Drug Administration (FDA) had only approved the drug for use in adults.
Jury Award for Risperdal Gynecomastia Under Fire
In February 2015, a jury awarded $2.5 million to Austin and his family, finding that Janssen failed to adequately warn the family and the medical community about the risks of Risperdal, including Risperdal gynecomastia.
The Johnson & Johnson subsidiary told the court that Austin’s mother’s testimony about her son’s Risperdal gynecomastia symptoms — that her son cried because of a teacher’s comment and is forced to wear a shirt when he goes swimming — was insufficient for the award promised by the court.
In seeking a reduction of the award, Janssen compared Austin’s Risperdal lawsuit with other cases, in which Pennsylvania courts had reduced damages for pain and suffering. One of the Risperdal lawsuits the company pointed to was that of a woman who suffered severe cognitive impairment. In that case, the court had reduced an $8 million verdict to $5 million.
The company claimed that the evidence presented in Austin’s case “did not come close to establishing that [Austin’s] injuries were worth 50 percent” of the $5 million awarded to the woman whose cognitive impairment effectively destroyed her normal life.
An attorney representing Austin is confident that the motion to reduce the award sum will be denied.
“The damages awarded to Austin P[] are well supported by the evidence — a ‘highly distressing injury’ by the very words of Janssen itself in medical literature,” he said.
Risperdal Side Effects
Risperdal (risperidone) is an antipsychotic medication approved by the FDA for the treatment of various mental and mood disorders. The conditions Risperdal is used to treat vary and include schizophrenia, bipolar mania, and autism.
Risperdal is intended to help people suffering from these conditions think more clearly and take part in everyday life. Atypical antipsychotics like Risperdal help restore the balance of various natural substances in the brain.

In some of these cases, boys had such excessive breast tissue grown that the breasts grew to “D” cups.
