WEN Class Action Lawsuit Says Products Caused Significant Hair Loss

hair_loss_searchA new class action lawsuit is challenging the makers of the WEN line of hair care products to answer allegations that their products actually cause hair to fall out.

More than 200 women from 40 different states filed the WEN class action lawsuit in federal court, alleging that the makers of WEN knowingly marketed a product that would damage hair. They allege that WEN products caused not just significant hair loss but also hair breakage, skin rash, and scalp irritation.

Named defendants in the WEN lawsuit include celebrity hair stylist Chaz Dean, who developed the WEN line of products, and the infomercial marketing firm Guthy-Renker, who have advertised the WEN line heavily through late-night infomercials.

WEN Hair Products Overview

WEN Cleansing Conditioner products are promoted as a sulfate-free alternative to shampoo. The products are supposedly intended to replace not just shampoo but also conditioner, deep conditioner, detangler and leave-in conditioner.

Thanks in part to heavy promotion by Dean and celebrities like Brooke Shields and Alyssa Milano, WEN has been a considerable business success. Sales in WEN’s second year on the market reportedly reached $100 million.

But online forums and comments have echoed consumers’ complaints about WEN products for months. Reviews on consumer advocate websites show reports from users that describe hair falling out in clumps, clogging drains and leaving visible bald spots.

WEN Class Action Lawsuit

Plaintiffs in this WEN class action lawsuit say that the products contain a harsh ingredient that causes a chemical reaction that damages hair and hair follicles. They allege that Dean and Guthy-Renker failed to warn customers about the dangers associated with using WEN products.

The plaintiffs cite marketing content on WEN’s website that describes WEN Cleansing Conditioner as being gentle enough for daily use. The website allegedly encourages users to use even more of WEN than they would of ordinary shampoo, saying that it’s impossible to use too much of it and that using more WEN will improve results.

The WEN class action lawsuit also accuses Guthy-Renker of deleting negative online reviews and removing comments from its Facebook page that referenced hair loss.

Plaintiff Amy Friedman specifically alleges that in January 2014 she bought the WEN Sweet Almond Mint kit for $29.95. She claims that within two weeks she began losing an extraordinary amount of hair.

Friedman says that even after she stopped using WEN, her hair loss continued for three more weeks, resulting in a total loss of one-quarter to one-third of her hair. She had to spend even more money on extensions to cover her bald spots, she says.

Some other plaintiffs are parents suing on behalf of their children who lost hair after using WEN. More plaintiffs could be included in this WEN lawsuit, which itself states the total number of plaintiff class members could number in the thousands or tens of thousands.

In a statement in response to the class action lawsuit, Guthy-Renker says there is no scientific evidence that their products have caused anyone to lose their hair. The company says they intend to vigorously contest the allegations made against them.
