Bellwether trials began this week for the Wright Conserve hip replacement multidistrict litigation.
The metal hip implant lawsuits against Wright Medical Technology allege that the company created a dangerous and defective product and failed to warn the medical community and the general public about risks associated with using the metal on metal hip implant.
The Wright Conserve hip replacement lawsuit, which was filed back in 2013 recently began jury selection. The metal-on-metal hip implant lawsuit was filed by Robyn C. after she suffered alleged injuries from the hip implant.
Plaintiff Robyn received the Wright Conserve hip implant back in April 2006. She underwent the surgery with the expectation that her new hip would last approximately 20 years. However, the hip lawsuit alleges that the device failed six years after it was initially implanted and a revision surgery was required to have the device removed in October of 2012.
Robyn is seeking compensatory damages for her pain and suffering, medical expenses and other economic losses, and emotional distress. She is also requesting punitive damages against Wright Medical Technology.
What is a Multidistrict litigation and a Bellwether Trial?
Multidistrict litigation sometimes occurs when several lawsuits have been filed against a defendant that involve similar facts and questions of law. There are currently 530 product liability lawsuits pending in federal court against Wright Medical Technology related to the Wright Conserve hip implant.
The multidistrict litigation allows all of these cases to be funneled before a single judge for pretrial motions and discovery. This helps promote efficiency and consistency among the cases and helps to ensure conflicting pretrial rulings do not occur. Currently the Wright Conserve metal on metal hip implant lawsuits have been centralized in the federal court in the Northern District of Georgia.
It is also common for bellwether trials to occur during multidistrict litigation. Bellwether trials involve a small number of cases that are set for early trial dates. These cases help other plaintiffs and defendants gauge how a jury will respond to the facts and evidence presented throughout the litigation. The revision surgery required to remove a metal-on-metal hip implant can be very difficult and cause patients additional pain and suffering along with a prolonged recovery time.
